NAVFORGE — TERMS OF USE

Please read these terms carefully before using NavForge (“the App”). By installing or using the App, you agree to these terms.
1. ABOUT THE APP
NavForge is an offline motorcycle navigation application that provides map viewing, route calculation, turn-by-turn navigation, ride recording, lean angle display, group ride tracking, and related features. The App is developed by Nick Chatzivayias (“we”, “us”, “our”).
2. SAFETY AND RIDER RESPONSIBILITY
2.1 The App is a navigation aid, not a substitute for safe riding practices. You are solely responsible for your safety and compliance with all road laws at all times.
2.2 Do not interact with the App while riding. Set your destination and route before you begin riding. Use voice-guided navigation and mount your phone securely.
2.3 Navigation directions may be inaccurate, outdated, or unsuitable for your vehicle or skill level. Always use your own judgment when following any suggested route. Unpaved tracks and adventure routes may be dangerous, unmaintained, or legally restricted in your area.
2.4 Speed camera locations are sourced from OpenStreetMap community data and may be incomplete, inaccurate, or outdated. Do not rely on speed camera alerts as your sole method of monitoring speed. You are responsible for obeying all speed limits regardless of whether the App displays an alert.
2.5 Lean angle display is an approximation based on phone sensor data. Accuracy depends on phone mounting position, calibration, and sensor quality. Do not use lean angle readings to determine safe cornering limits. The display is for entertainment and general awareness only.
3. ROUTING AND MAP DATA
3.1 Routes are calculated offline using map data from OpenStreetMap, which is community-maintained and may contain errors, omissions, or outdated information.
3.2 Road conditions, closures, access restrictions, and legal status of roads may change without notice. The App does not provide real-time traffic or road condition information.
3.3 Cross-border routing requires both regions to be downloaded. The App cannot route through areas where map data has not been downloaded.
3.4 Curvature-seeking routing intentionally directs riders toward winding roads. These roads may be more challenging and potentially more dangerous than direct routes. Use appropriate caution and ride within your ability.
4. GROUP RIDE
4.1 Group Ride shares your GPS position with other riders in your session. Your position is visible to anyone who has the session code. Share your session code only with people you trust.
4.2 Position updates occur periodically and may be delayed or unavailable due to network conditions. Do not rely on Group Ride as your sole method of tracking riding companions.
4.3 Group Ride session data is transmitted over HTTPS and automatically deleted within 24 hours.
5. SUBSCRIPTION AND PAYMENTS
5.1 The App offers a free tier with limited features and a premium tier (currently A$29.99/year) with additional features.
5.2 Subscriptions are billed through Google Play (Android) or Apple App Store (iOS) and are subject to their respective terms and refund policies.
5.3 Subscription auto-renews unless cancelled at least 24 hours before the current period ends. You can manage your subscription through your Google Play or Apple App Store account settings.
5.4 We reserve the right to change subscription pricing. Any price change will apply to the next renewal period, not the current one.
5.5 Free tier features may change over time. We will endeavour to maintain core free functionality but make no guarantees about specific features remaining free.
6. OFFLINE FUNCTIONALITY
6.1 Core features (map viewing, routing, navigation, lean angle, ride recording) work fully offline after downloading a region.
6.2 Some features (Group Ride, online search, region downloads, subscription validation) require an internet connection.
6.3 Downloaded map data may become outdated. We recommend updating your regions periodically to receive the latest road data.
7. YOUR DATA
7.1 All ride recordings, markers, routes, and personal settings are stored locally on your device. We do not have access to this data.
7.2 You are responsible for backing up any data you wish to keep. Uninstalling the App will permanently delete all local data.

8. INTELLECTUAL PROPERTY
8.1 The App, including its design, code, and branding, is our intellectual property.
8.2 Map data is © OpenStreetMap contributors and is used under the Open Database License (ODbL).
8.3 You may not reverse engineer, decompile, or extract the routing engine or any proprietary components of the App.
9. LIMITATION OF LIABILITY
9.1 The App is provided “as is” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy of navigation data.
9.2 To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
– Personal injury or death
– Property damage
– Loss of data
– Inaccurate routing or navigation directions
– Inaccurate speed camera alerts
– Inaccurate lean angle readings
9.3 You use the App entirely at your own risk. Motorcycle riding is inherently dangerous. The App does not reduce the risks associated with motorcycle riding.
10. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of these terms.
11. TERMINATION
We reserve the right to terminate or suspend access to the App at any time, for any reason, without notice. Upon termination, your right to use the App ceases immediately.
12. GOVERNING LAW
These terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
13. CHANGES TO THESE TERMS
We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the updated terms.
